The duty to manage applies to all commercial and some domestic premises (please see, Domestic Landlords for further information) built before the year 2000. The duty applies to:
- Internal and external areas of all buildings
- All external areas or grounds within larger sites
- Parts of premises where only facilities are used, including for access or egress
- Embedded spaces in relation to refurbishment or maintenance projects
If you have control of a premises, are a manager, landlord, duty holder or responsible for maintenance and repair, you are required to protect others who work or use the premises from asbestos exposure. To comply with the law, you should undertake:
- A sufficient assessment carried out as to whether asbestos is present or is liable to be located within premis.e
(Asbestos Management Survey) - A risk assessment of all sampled or presumed asbestos containing materials.
(Asbestos Management Survey) - A written plan on how to manage the risks of asbestos within all premises, for which you own, manage or lease.
(Asbestos Management Plan) - An Asbestos Refurbishment and Demolition Survey before any intrusive works disturbing the fabric of the building.
- Asbestos awareness training for all employees that may come into contact with asbestos, further training may be required for staff assisting in the management of asbestos.
